Abstract

The Gending Sugar Factory was established in the Japanese occupation until now, this factory is located in Probolinggo Regency precisely in Gending, Gending District, Probolinggo district. Partnership is a relationship between two or more parties that aims to seek profits where a party is in a condition that is lower than the others but forms a relationship that places both of them based on an agreement to achieve a goal. In a partnership has a relationship that is, has the same goal. Winwin solution. Mutual trust. Open. Have a long term relationship, make improvements in quality and price / cost. This partnership must also have the name of a profit sharing system where the financing system that is mostly carried out by the world of Islamic banking is the system in which agreements are made or joint bonds in conducting business activities. In this business there is a promise of the sharing of profits for profits that will be obtained between the two parties or more. The purpose of this study was to analyze the partnership between sugar cane farmers and the Gending sugar factory and the procedure for the production sharing agreement between farmers and the Gending sugar factory. The problem approach used in this study is an empirical / sociological juridical approach. The empirical / sociological juridical approach, the author focuses on the gap between the articles in the legislation and the reality that exists in the community. The results of this study are, the partnership built by sugar cane farmers with the Gending Sugar Factory in its contract patterned plasma nucleus through discussion and agreement between the two parties. This contract involves regulations that must be obeyed by both, one of which is about the distribution of the results of the sugar cane milling based on the yield that comes out. Because the ignorance of education that lies behind the inhibiting factors, the farmers suggest that they slaughter in matters of agreement so that they don't go wrong and consider everything so that in the future it will be good for their fighting life.
